Buying and selling rules

If you decide to purchase Ragainė product in this e-shop, you agree to the terms and conditions below.

  1. Basic provisions

1.1. These Terms and Conditions of Purchase and Sale (hereinafter referred to as the “Terms and Conditions”) set out the rights, obligations and responsibilities between the person purchasing goods from www.ragaine.lt (hereinafter referred to as the “Buyer”) and VŠĮ Baltijos griaustinis (hereinafter referred to as the “Seller”) in connection with the Buyer’s purchases of goods in the e-shop. By purchasing goods in the online shop, the Buyer agrees to the application of these Terms and Conditions.

1.2 The following are entitled to make purchases in the Online Shop:

  • natural persons of legal capacity, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court order;
  • minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, unless they are self-sufficient in terms of income;
  • legal persons.

By placing an order, the Customer confirms that he/she has the right to make purchases in the Online Shop.

1.3 The Seller has the right to unilaterally change, amend or supplement the Terms and Conditions. The Buyer’s purchases in the Online Shop shall be subject to the Terms and Conditions in force at the time of placing the order, and the Buyer should familiarise himself with the Terms and Conditions at the time of each purchase.

1.4 The Seller shall not be liable for the Buyer’s failure to read the Terms and Conditions when given the opportunity to do so. The Seller accepts no risk or liability for this and is unconditionally relieved of it.

1.5 If the Buyer uses the Intenet Shop in breach of these Terms and Conditions or otherwise attempts to interfere with the operation of the Online Shop, the Seller shall have the right to restrict the Buyer’s use of the services of the Online Shop without prior notice.

1.6 The Seller shall have the right to suspend or terminate the operation of the Online Shop without prior notice to the Buyer.

  1. Conclusion of the Purchase and Sale Agreement

2.1 The Purchase and Sale Contract between the Buyer and the Seller shall be deemed to have been concluded from the moment the Buyer clicks on the “Order” button in the online shop after having created a shopping cart, specified the delivery address, selected the payment method and read these Terms and Conditions, and shall remain in force until the obligations under this Contract have been fully performed. In cases where the Buyer does not accept all or part of the Terms and Conditions, the Buyer must not place an order.

  1. Seller’s rights

3.1 If the Buyer attempts to undermine the operation or stable functioning of the Online Shop or violates his/her obligations, the Seller may, without prior notice, restrict, suspend (terminate) the Buyer’s access to the Online Shop, and shall not be liable for any losses incurred by the Buyer in connection therewith.

3.2 The Seller shall be entitled to suspend or terminate the operation of the e-shop without prior notice and shall not be liable for any loss incurred by the Buyer in connection therewith.

3.3 The Seller has the right to unilaterally amend these Terms and Conditions by posting them on the website of the e-shop. Amendments shall take effect from the moment of publication for all transactions entered into after publication.

3.4 The Seller shall have other rights provided for in the Terms and Conditions and the legislation of the Republic of Lithuania.

  1. Obligations of the Seller

4.1 The Seller undertakes to use its best efforts to enable the Buyer to make proper use of the services provided by the e-shop. The Seller makes no warranty that the operation of the Online Shop will be uninterrupted or that the transmission of data will be error-free. The Seller shall not be liable for any losses incurred by the Buyer in connection with malfunctions and/or data transmission errors in the electronic shop.

4.2 In the event of serious circumstances where the Seller is unable to provide the Buyer with the goods ordered, the Seller undertakes to offer an equivalent product or refund the Buyer’s payment within 14 working days. In this case, the Seller shall be exempt from liability for non-delivery.

4.3 The Seller undertakes to comply with the other requirements set out in these Rules.

  1. Rights of the Buyer

5.1 The Buyer shall have the right to purchase goods in the e-shop in accordance with these Terms and Conditions and the legislation of the Republic of Lithuania.6.

5.2 The Buyer (consumer) shall have the right to withdraw from the contract for the purchase and sale of goods concluded in the electronic shop with the Seller by notifying the Seller in writing within 14 working days from the date of delivery of the goods. The Buyer shall have the right to withdraw from the contract with the Seller only if the goods are of good quality, have not been damaged and have not substantially changed their appearance.

5.3 The Buyer shall have other rights provided for in the Rules and the legislation of the Republic of Lithuania.

  1. Obligations of the Buyer

    6.1 The Buyer shall pay the price of the Goods and their delivery, as well as any other payments (if any, specified at the time of entering into the Contract) and accept the Goods ordered. The Buyer shall pay for the Goods by using his/her online bank, which is linked to from the Online Shop (if the Seller has an agreement with the Buyer’s bank).

    6.2 The Customer may not use more than one discount voucher per purchase after placing the Goods in the shopping cart.

    6.3 The Customer shall comply with other requirements set out in the Rules and the legislation of the Republic of Lituania.

    1. Prices of goods, payment procedure and terms of payment for goods

    7.1 The prices of the Goods in the Online Shop and in the order shall be quoted in Euros. The Goods shall be sold to the Buyer at the prices valid in the Online Shop at the time of placing the order. The Seller has the right to set a minimum order size, i.e. a minimum amount at which the Buyer’s order is fulfilled.

    7.2 The Buyer completes the order in the Online Shop and chooses the payment method that suits him/her in the “Payment method” step of the order.

    7.3 When the Buyer transfers money to the Seller’s account, the responsibility for data security in this case rests with the respective bank, as all monetary transactions take place in the bank’s electronic banking system.

    7.4 The order shall only commence upon receipt of payment for the Goods and their delivery, and the time limit for delivery of the Goods shall begin to run.

    1. Methods of delivery

    8.1 The Seller undertakes to dispatch the Goods within 3 working days (excluding public holidays) of confirmation of payment of the order. These time limits shall not apply in cases where the Seller does not have the goods in stock and the Buyer is informed of a shortage of the goods ordered. The Buyer also agrees that in exceptional circumstances the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In such a case, the Seller undertakes to contact the Buyer immediately to agree on the delivery of the goods.

    8.2 The ordered goods shall be delivered in the territory of Lithuania through the parcel office of AB Lietuvos paštas, terminals of LP express, post offices of UAB Omniva and courier service. In Latvia and Estonia we deliver the goods through the parcel office of AB Lietuvos paštas, as well as UAB Omniva post offices and courier service. In other foreign countries, we send goods via AB Lietuvos paštas.

    8.3.For delivery of ordered goods by other methods, in cases of extreme urgency, the Buyer may apply personally to the contacts indicated in the Online Shop – the Seller undertakes to meet such needs of the Buyer and, if possible, to seek another method of delivery, while the Buyer undertakes to pay an additional fee agreed by mutual agreement.

    8.4 In all cases, the Seller shall be exempt from liability for failure to meet delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Buyer’s control.

    8.5 The Buyer shall choose the method of delivery of the goods ordered. The Seller shall not be liable if the goods are damaged, defaced or dented by the delivery service providers during shipment.

    8.6 The cost of the packaging of the ordered goods to be shipped, as well as the cost of any additional materials required for this purpose, shall be included in the total price of the delivery. The Seller shall undertake to pack the goods shipped properly and safely, using its experience, the recommendations of the delivery service providers and the most appropriate types of packaging.

    8.7 The ordered goods can be collected from the physical Ragainės store in Vilnius (Skapo g.3) during its opening hours. Collection of the order in the store must be indicated when ordering the goods, or the Buyer must inform the Seller about it separately.

    1. Processing of personal data

    9.1 By clicking on the “Order” button, the Buyer confirms that he/she agrees to provide the Seller with his/her personal data: name, surname, e-mail address, telephone number and delivery address. The Buyer is responsible for the correctness of the data provided. The Buyer accepts responsibility for the consequences arising from any incorrectness or inaccuracy of the data provided. If the Buyer provides inaccurate, false or misleading data, the Seller has the right to cancel the order.

    9.2 The Seller recognises and respects the right to privacy of every natural person who visits the online shop www.ragaine.lt. The Seller collects and uses the data of the natural person only for the purpose of ordering and delivering goods.

    9.3 Subject to the Buyer’s consent, the Seller may send the Buyer, via the e-mail address provided, news and offers related to the activities or offers of the Shop. The Buyer may unsubscribe from such emails at any time.

    1. Final provisions

    10.1 All disputes arising out of or in connection with the contract of sale between the Buyer and the Seller shall be settled by good faith agreement or negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedure laid down by the legislation of the Republic of Lithuania.
